Welcome to QZee! These Terms of Use ("Terms") govern your use of the QZee application and services ("Platform"). By using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.
1. Definitions
"Platform" refers to the QZee application, website, and any related services provided.
"Business Users" are businesses or service providers using the Platform to manage bookings and interact with Consumers.
"Consumers" are individuals using the Platform to discover, interact with, and book services offered by Business Users.
"Services" refer to the functionalities provided by QZee, including but not limited to booking management, queue optimisation, and content uploads.
2. Role of QZee
QZee is an intermediary platform facilitating connections and bookings between Consumers and Business Users. QZee does not provide, manage, or guarantee the services offered by Business Users.
QZee does not handle payments between Consumers and Business Users. Any payment-related issues must be resolved directly between the parties involved.
QZee is not liable for the quality, legality, or suitability of services offered by Business Users.
3. Business User Responsibilities
By registering on the Platform, Business Users agree to:
Provide accurate, up-to-date information about their services, including but not limited to descriptions, availability, policies, and contact details.
Ensure all uploaded content (e.g., photos, descriptions, promotions) complies with applicable laws and does not contain false, misleading, or offensive material.
Honour bookings and manage cancellations according to their specified policies.
Comply with all applicable laws and regulations, including those related to consumer rights and age restrictions for services.
Assume full responsibility for resolving disputes with Consumers regarding their services.
QZee reserves the right to remove any content or terminate accounts that violate these Terms or applicable laws.
4. Consumer Responsibilities
By using the Platform, Consumers agree to:
Provide accurate and complete information when making bookings.
Review and accept the Business User’s policies, including cancellation and refund terms, before confirming a booking.
Assume responsibility for ensuring their eligibility for the services they book (e.g., age restrictions).
Resolve any disputes related to bookings or services directly with the Business User.
5. Content Submission and Intellectual Property
Business Users and Consumers may upload content (e.g., business profiles, reviews, or promotional materials).
All submitted content must be lawful, non-infringing, and free from offensive or inappropriate material.
QZee reserves the right to review, remove, or modify content that violates these Terms or applicable laws.
By uploading content, Users grant QZee a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, and distribute the content solely for the purposes of operating and promoting the Platform.
6. Booking, Cancellation, and Refunds
Business Users set their own booking, cancellation, and refund policies. Consumers are responsible for reviewing these policies before confirming a booking.
QZee is not responsible for enforcing or mediating refund requests between Consumers and Business Users.
Platform-related refunds (e.g., subscription fees for Business Users) will be considered on a case-by-case basis if a valid claim is presented.
7. Limitation of Liability
To the fullest extent permitted by law:
QZee is not liable for any direct, indirect, incidental, or consequential damages arising from the use of the Platform, including but not limited to disputes between Users, service quality issues, or missed bookings.
QZee does not guarantee uninterrupted or error-free operation of the Platform.
8. Data Protection and Privacy
Your use of the Platform is subject to our Privacy Policy. By using QZee, you consent to the collection, use, and storage of your information as outlined in the Privacy Policy.
9. Eligibility
QZee does not enforce age restrictions for bookings. It is the responsibility of the Business User to ensure compliance with legal and regulatory requirements for their services, including age-related restrictions.
Consumers must comply with any restrictions or requirements imposed by Business Users.
10. Platform Fees
QZee may charge Business Users subscription or service fees for accessing certain features of the Platform. These fees are non-refundable unless explicitly agreed upon by QZee in writing.
11. Termination of Access
QZee reserves the right to suspend or terminate access to the Platform for any User who:
Violates these Terms or any applicable laws.
Engages in fraudulent or abusive activities.
12. Dispute Resolution
Any disputes between Consumers and Business Users must be resolved directly between the parties involved.
For disputes directly related to the Platform, Users agree to contact QZee’s support team to attempt resolution before pursuing further action.
These Terms are governed by UK law. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
13. Modifications to Terms
QZee reserves the right to modify these Terms at any time. Updated Terms will be posted on the Platform, and continued use constitutes acceptance of the changes.
